Terms of Service for Tsada Expeditions

These Terms of Service ("Terms") govern your use of the Tsada Expeditions website and mobile application (the "Service"). By accessing our Service or booking a vehicle, you agree to be bound by these Terms.

1. Eligibility and Registration

  1. Age Requirement: You must be at least 21 years old to rent a vehicle.

  2. Driver’s License: You must possess a valid, unexpired Professional or Non-Professional Philippine Driver’s License. Foreigners must provide a valid passport and an International Driving Permit (IDP) if their license is not in English.

  3. Account Security: You are responsible for maintaining the confidentiality of your app login credentials. All bookings made through your account are your responsibility.

2. Rental Terms and Conditions

  1. Rental Period: The rental starts at the agreed pickup time and ends when the vehicle is returned to our designated hub and inspected by our staff.

  2. Late Returns: A grace period of 30 minutes is provided. Beyond this, a penalty of ₱500 per hour will apply. Returns delayed by more than 4 hours will be charged as a full additional day.

  3. Fuel Policy: Vehicles are provided with a full tank of fuel and must be returned with a full tank. Failure to do so will result in a refueling charge plus a 15% service fee.

3. Prohibited Use

The vehicle shall not be used:

  1. For any illegal purpose or in violation of the Land Transportation and Traffic Code (RA 4136).

  2. To carry passengers or property for hire (e.g., as a "colorum" or TNVS vehicle).

  3. For racing, off-roading, or driving on flooded/unpaved roads.

  4. By any person under the influence of alcohol or drugs.

  5. To transport hazardous or prohibited materials.

4. Fees, Payments, and Deposits

  1. Booking Fee: A non-refundable reservation fee may be required to secure your booking.

  2. Security Deposit: A refundable security deposit (amount varies by vehicle type) is required upon pickup. This will be refunded within 7–14 business days after the vehicle is returned without damage or traffic violations.

  3. Cancellations: Cancellations made within 24 hours of the pickup time are subject to a cancellation fee equivalent to one day’s rental.

5. Insurance and Liability

  1. Insurance Coverage: Our vehicles are covered by Comprehensive Insurance and Compulsory Third Party Liability (CTPL).

  2. Renter Responsibility: In the event of an accident, the renter is liable for the insurance deductible/participation fee.

  3. Full Liability: The renter is 100% liable for damages caused by gross negligence, drunk driving, or unauthorized drivers not listed in the booking.

6. Mobile App Usage & Data

  1. Permissions: The App requires access to your Location and Camera for booking and identity verification purposes.

  2. Termination: We reserve the right to suspend your account for fraudulent activity, multiple late returns, or violation of these Terms.

7. Governing Law

These Terms are governed by the laws of the Republic of the Philippines. Any legal disputes arising from these Terms shall be settled in the courts of Dumaguete City.
